Terms of service
Design Temple
Effective date: July 2026
These Terms of Service govern the relationship between Design Temple ('we', 'us', 'the studio') and any person or company that subscribes to our design services ('you' or 'the client'). By subscribing to any of our plans, you confirm that you have read, understood, and agreed to these terms in full. If you have questions before subscribing, book a free 15-minute call and we'll walk you through it.
1. Overview
Design Temple is a design subscription service. For a flat monthly fee, you get access to a dedicated designer ('Design Artisan', 'Design Master') or a development specialist ('Web Artisan') whose work sits on your brand's requests on an ongoing basis. There are no contracts, no long-term commitments, and no per-project hidden charges. That is the promise.
We are not a traditional agency. We are a human-driven design studio. We do not operate on project-based contracts or one-time engagements. The service is entirely subscription-based, which means the terms below apply to each and every active month you are subscribed. The only exception is agency-mode work described in Section 4, which is quoted and agreed separately.
Active Production Month
When you subscribe, you purchase 30 days of our active production time, not 30 calendar days. This means:
You pay for 30 days of Design Temple working on your project
If the project is paused while waiting on your feedback, approvals, or content, the clock stops. You don't pay for the waiting time
Only you can pause your subscription. You are the sole controller of your billing
When you're ready to resume, we pick up where we left off
The actual calendar duration of your subscription depends on how much work is paused and resumed. It could span 30 days, 60 days, or longer
2. The Plans

About Our Roles
Design Artisan (Junior Designer): A skilled designer with foundational experience across branding, packaging, and marketing. Ideal for brands building their initial visual identity or needing consistent design support. Available in A New Canvas plan only.
Design Master (Senior Designer): An experienced designer with deep expertise across all design disciplines. Brings strategic thinking to visual problems and can lead complex brand projects. Available in Workshop and Digital Atelier plans.
Web Artisan (Web Developer/Specialist): A dedicated web specialist focused on web design and development using front-end technologies (HTML, CSS, JavaScript, React), WordPress, Framer, and no-code platforms. The Web Artisan is separate from design roles and handles all web development work within Digital Atelier, within the monthly development hours described in Section 4. This role is only available in the Digital Atelier plan.
3. What We Design
We can design anything that can be clearly articulated or visualized. This includes (but is not limited to):
Brand identity (logos, color systems, typography, brand guidelines)
Packaging design (boxes, labels, product materials)
Marketing materials (flyers, business cards, presentations, postcards)
Social media assets (posts, stories, reels, graphics)
Web design & development (landing pages, WordPress, front-end, Framer, no-code). Digital Atelier only, within the Web Development Scope described in Section 4
Illustrations and custom artwork
Editorial and layout design
Anything visual that you can describe and we can create
Requests that fall outside subscription scope are handled in two ways. Full digital products (mobile apps, complex multi-page platforms, back-end or full-stack development) are available as separate agency projects, as described in Section 4. Video production, photography, and Adobe Suite design fall outside our service entirely; we'll communicate this clearly and suggest alternatives or refer you to partners we trust.
4. Web Development Scope (Digital Atelier)
Web work in Digital Atelier is powerful, and it has clear limits. We'd rather define them here than surprise you later.
What's included
Your Digital Atelier subscription includes up to 40 hours of active web development per Active Production Month. This covers landing pages, WordPress sites, front-end work (HTML, CSS, JavaScript, React), Framer projects, no-code builds, and updates or maintenance to sites we've built for you.
Extended sprints
If a given month calls for more, we can extend up to a maximum of 60 development hours, only by prior written agreement between you and Design Temple. Sixty hours is the absolute ceiling for subscription work in any single Active Production Month. Beyond that point, the work is handled as an agency project.
Hour tracking
Development hours are tracked by Design Temple and a summary is available to you upon request. Unused development hours do not accumulate and do not roll over to the following month. They are a monthly subscription benefit, not a banked balance.
Full products are a different journey
Mobile apps, complex multi-page platforms, e-commerce systems, back-end development, and complete software products are not covered by the subscription. We are fully capable of building them, and we do, through our agency modality: a separate proposal with its own scope, timeline, and budget, billed hourly starting at $33 USD per hour. Agency projects are governed by their own written proposal in addition to these terms.
No surprises, ever
Before starting any web request, we will tell you clearly whether it falls within your subscription or requires an agency proposal. Work never moves from one category to the other without your written approval.
5. Turnaround Times
When you submit a request, our designer(s) will confirm receipt and scope within 1-2 business days and provide an estimated delivery date. Business days are Monday through Friday, excluding US federal holidays.
Estimated delivery dates are provided as best estimates. We aim to exceed them. Turnaround times depend on production complexity and begin counting from the moment we start active work.
Important: You are responsible for moving tasks through your project board or tracking system. Design Temple does not manage your Kanban, task status, or project visibility. Communicate clearly when work is ready for review, and we'll respond promptly.
6. How Revisions Work
Revisions are unlimited. We keep working on a design until you are satisfied. To request a revision, use the comment tool in our internal platform where designs are uploaded, or we can share a Figma file for collaborative feedback. You can also provide direct notes if you prefer.
A single revision round counts as one 'touch.' If a revision requires fundamental changes to the original creative direction, we may ask clarifying questions to ensure we're aligned. Once we've locked a design and both parties agree it's complete, the next piece of work counts as a new task.
7. File Delivery and Pausing
Files are delivered in industry-standard formats appropriate to the project type: Affinity files, SVG, EPS, PNG, JPG, and other vector/raster formats. We do not use or deliver Adobe Suite files (PSD, AI, etc.).
Editable source files (Affinity, design project files) are included with all plans. Figma files and source code repositories are shared for reference but are not considered 'editable deliverables' and do not transfer ownership of the design system or codebase.
Design Temple is not responsible for storing your files indefinitely. We recommend downloading and backing up all delivered files immediately. We cannot guarantee the recovery of files or content after a subscription ends.
Pausing Your Subscription
You can pause your subscription at any time. When paused:
The billing clock stops immediately
Any banked days remain on your account until you resume
When you're ready to resume, go to your Dashboard, select the 'Billing' tab, and reactivate your subscription by changing the 'Status' to Active
Design Temple only pauses work for reasons beyond our control: specifically, medical emergencies, health complications, or natural disasters affecting our team. We will notify you immediately if this occurs and work out a resume date together. We do not pause because of revision cycles, waiting for your feedback, or any other project dependencies. You control the pause; we stay committed.
8. Billing and Cancellation
Your subscription is billed monthly in advance on the date you sign up. You may pause or cancel your subscription at any time, with no notice period required, no cancellation fees, and no refund penalties.
If you cancel mid-cycle, your subscription remains active until the end of your paid period. No prorated refunds are issued. If you pause your subscription, the billing clock stops and resumes only when you reactivate.
7-Day Money-Back Guarantee
For new subscribers, we offer a 7-day money-back guarantee on your first month. If you're not satisfied within 7 days, request a full refund and your subscription ends with no further charges. This guarantee applies to first-month subscriptions only.
9. Refunds
Outside the 7-day initial guarantee, refunds are handled on a case-by-case basis. Design Temple is designed to deliver ongoing work, not issue refunds. If a refund is warranted, it will be reviewed and approved by Design Temple, processed via PayPal, and may be subject to a deduction of refund-related administrative costs.
10. Intellectual Property and Ownership
All rights to designs, illustrations, layouts, and original creative work produced and delivered by Design Temple during your subscription automatically transfer to you (the client/subscriber) upon delivery. You own the work.
Design Temple retains the right to:
Display completed projects in our portfolio, on our website, and in social media for promotional purposes
Reference your work in case studies and marketing materials
Use anonymized examples of our design work in educational or promotional contexts
You can request anonymity or confidentiality for specific projects, but this does not guarantee Design Temple won't use the work in our portfolio or communications unless explicitly agreed in advance.
11. Third-Party Assets and Licensing
Design Temple may use stock imagery, illustrations, fonts, or other licensed assets in your work. When we do, we will advise you in writing and specify which licenses you need to obtain independently. In most cases, a single license per project is sufficient.
All fonts used in final deliverables are licensed for your use. We guarantee that all stock and licensed assets can be legally used for the intended purpose. Design Temple accepts no liability for claims arising from client-provided materials or assets.
12. Acceptable Use
By subscribing, you agree not to use Design Temple's services to create content that is illegal, discriminatory, defamatory, or in violation of any third-party's rights. You further agree not to misrepresent your identity or the nature of the work.
If Design Temple becomes aware that you are using the service in a manner inconsistent with this clause, Design Temple retains the right to terminate your subscription immediately and without refund if a client is found to be in material breach of this section.
13. What We Don't Do
We do not guarantee SEO or legal review of designs. We do not conduct trademark research or patent management. Any designs intended for trademark registration should be reviewed by a qualified intellectual property attorney.
We do not guarantee that designs will meet specific legal, regulatory, or platform-specific requirements. The client is responsible for verifying that delivered designs comply with all applicable laws, platform guidelines, and industry standards. For questions or concerns, consult the appropriate legal, regulatory, or platform specialists.
14. Electronic Communications
By subscribing, you consent to receive communications from Design Temple electronically, including through your email address, iMessage, WhatsApp, or other digital channels. You agree to the use of electronic signatures and that all such communications be considered in writing.
15. Limitation of Liability
Design Temple's total liability to the client for any claim arising from or related to the service is limited to the amount paid by the client in the month in which the claim arises. We do not take liability for indirect, incidental, special, or consequential damages of any kind, including lost revenue, lost business opportunities, or reputational damages.
The foregoing limitations apply to all claims, whether arising in contract, tort, or any other legal theory, to the fullest extent permitted by law.
16. Indemnification
The client agrees to indemnify, defend, and hold harmless Design Temple and its team members from and against any loss, damage, liability, claim, or demand, including reasonable legal fees, arising out of the client's use, misuse, or modification of the designs or any claim that the client is not at liberty to do so.
17. Changes to These Terms
Design Temple may change or modify these terms at any time. When we do, we will update the effective date at the top of this page. Changes are binding, and we will notify subscribers by email with reasonable advance notice. Continued use of the service after the effective date of any updates constitutes acceptance of the revised terms.
18. Governing Law
These terms are governed by and construed in accordance with the laws of Chile. Any dispute arising from this agreement will be subject to the exclusive jurisdiction of the courts of Santiago, Chile.
19. Miscellaneous
These terms, together with any policies published on our website and any agency-project proposals signed under Section 4, constitute the entire agreement between Design Temple and the client. If any provision of these terms is found to be unenforceable, that provision will be severed and the remaining terms will continue in full force and effect.
Failure by Design Temple to enforce any right or provision does not constitute a waiver of that right. Nothing in these terms creates a partnership, employment, or agency between the client and Design Temple.
20. Contact
If you have questions about these terms or your subscription, email jose@designtemple.cl or book a call at designtemple.cl. A team member will get back to you.
